Terms of Service

1. The agreement

By creating a ViralHunter account or using the service, you agree to these terms. If you don't agree, don't use the service.

2. What ViralHunter is

ViralHunter is a content-intelligence tool that helps faceless content creators track high-performing Instagram and TikTok videos, transcribe them, analyze their angles, and generate new scripts in their own voice using AI. We collect publicly available video metadata via third-party scraping services and process it on your behalf.

3. Your account

You're responsible for keeping your password safe and for everything that happens under your account. Tell us immediately at support@viralhunter.app if you suspect unauthorized access. One person per account; sharing accounts violates these terms.

4. Acceptable use

You agree not to:

• Reverse-engineer or scrape ViralHunter itself
• Use the service to harass, defame, or impersonate any creator whose content you track
• Republish ViralHunter-generated content (transcripts, analyses, scripts) as if it were your own original analysis without modification
• Use the service to generate content that violates Instagram, TikTok, Anthropic's, or applicable platform terms
• Attempt to bypass usage limits, paywalls, or rate limits

We reserve the right to suspend accounts that abuse the service or run up disproportionate API costs.

5. Billing

Paid plans are billed monthly in advance via Stripe, our payment processor. Charges renew automatically until cancelled. Cancel any time from your account Settings → Plan → Manage, which opens Stripe's hosted billing portal where you can also update your payment method and download past invoices.

We may change pricing with 30 days notice via email. Existing subscribers keep their current price for at least the next billing cycle after a change is announced.

5b. Delivery

ViralHunter is a software-as-a-service product delivered electronically. Access to your subscription tier is granted instantly the moment Stripe confirms your payment — there is no shipping period, no waiting list (except for plans we explicitly gate behind one), and no physical product. If you don't see your plan reflected within a few minutes of payment, email support@viralhunter.app and we'll resolve it.

5c. Support

Email support@viralhunter.app for any question, billing dispute, or technical issue. We aim to respond within 1 business day. Innovator subscribers get priority support with a target same-day response. Critical billing issues (double charge, charge after cancellation) are handled the same day regardless of plan.

5a. Refunds

Subscriptions are non-refundable for partial months. When you cancel a paid plan, your access stays active through the end of the current billing period and then ends — we don't pro-rate refunds for the unused portion.

Billing errors: if you were charged twice, charged after cancellation, or charged for a period you couldn't access the service, email support@viralhunter.app within 30 days of the charge and we'll review. Approved refunds are processed back to your original payment method via Stripe within 5–10 business days.

Chargebacks: please contact us before disputing a charge with your bank — we can usually resolve issues faster directly. Filing a chargeback without first contacting us may result in your account being suspended pending review.

Free tier: the Free plan has no charges, so no refund applies.

6. Content ownership

You own everything you create in ViralHunter — your scripts, your voice profile, your saved videos, your collections. We claim no rights over your content.

Videos and metadata scraped from Instagram/TikTok belong to their original creators and are subject to their respective platform terms. ViralHunter is a tool for finding and learning from public content, not for republishing it.

7. AI-generated content

Scripts generated by ViralHunter are produced by Claude (Anthropic). Like any AI output, they may occasionally be inaccurate, biased, or similar to existing content. You're responsible for reviewing and editing AI-generated scripts before publishing them. We don't guarantee that AI output is original or fact-checked.

7a. Copyright complaints (DMCA)

ViralHunter analyzes publicly-available video content from Instagram and TikTok. If you believe content surfaced through the service infringes your rights, send a notice to support@viralhunter.app including:

• The URL or specific item on ViralHunter you want removed.
• A description of the original work and your ownership of it.
• Your contact information (name, address, phone, email).
• A statement that you have a good-faith belief the use isn't authorized, and that the information in your notice is accurate.
• Your physical or electronic signature.

We'll review and respond within 10 business days. Repeat infringers' accounts are terminated.

8. Service availability

We aim for high uptime but don't guarantee any specific service level. Apify, Anthropic, and our other dependencies can fail; when they do, parts of ViralHunter will too. We'll work to restore service quickly and won't charge for time you couldn't use the service due to extended outages.

9. Termination

You can delete your account any time. We can suspend or terminate accounts that violate these terms, run up extraordinary API costs, or are inactive for over 12 months (with notice).

10. Liability

ViralHunter is provided "as is." Our total liability for any claim related to the service is limited to the amount you paid us in the 12 months before the claim. We're not liable for indirect or consequential damages.

10a. Governing law and disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Before filing any formal claim, please email support@viralhunter.app so we can try to resolve it directly. Any unresolved claim shall be settled by binding arbitration administered by the ADR Institute of Canada under its Arbitration Rules, seated in Toronto, Ontario. You and ViralHunter each waive the right to a jury trial and, to the extent permitted by applicable law, to participate in any class action; claims must be brought individually.

11. Changes to these terms

We may update these terms. Material changes will be emailed to active accounts at least 14 days before they take effect. Continuing to use ViralHunter after the effective date means you accept the new terms.
